FAQ

Questions owners ask us

If yours isn’t here, ask it on a first call; there’s no charge for the call.

The firm

Who do you represent?

Landlords, property owners and the managers who act for them. We never represent tenants.

Do you work outside Dayton?

Yes. We meet owners by video anywhere in the state, and tell you before you sign if a court wants a lawyer there in person.

I own one rental. Am I too small?

No. Most of our clients own between one and ten units.

Fees

What does a flat fee leave out?

What the court charges, like filing and bailiff fees, and any stage named as excluded in the fee, such as a contested trial. Each fee on the fees page lists both.

What happens if a case goes past the fee?

We stop and quote the next stage in writing. Nothing more is billed unless you agree to it.

Evictions

How long does an eviction take?

It depends on the court’s calendar. On the first call we tell you how far out hearings are being set in your county.

Can I evict a tenant without a lease?

Yes, a month-to-month tenancy can be ended with the right notice. We’ll tell you which notice applies.

Can a tenant stop an eviction by paying?

Sometimes, depending on the stage and how the lease is written. You decide whether to accept payment and dismiss, and we tell you what each choice means first.
